Terms of Service

1. Purpose

These Terms of Service ("Terms") govern access to and use of the Balm mobile application and the balm.cool website (together, the "Service"), published by LBC. By creating an account, starting the free trial, or using the Service in any way, you accept these Terms in full. If you do not accept them, you must not use the Service.

Balm centralizes everyday appointments, errands and tasks: reminders sent with a lead time you choose, a task list kept separate from your calendar, and a home screen widget. The Service is provided "as is" and evolves regularly; features may be added, changed or removed without this constituting a material change to these Terms.

4. User Account

Some features of the Service require creating an account. You must be at least 16 years old, or have the consent of a parent or legal guardian if you are a minor. You are responsible for keeping your credentials confidential and for any activity carried out through your account. You agree to provide accurate information and keep it up to date.

5. Subscriptions, Free Trial and Pricing

Balm offers a one-month free trial, no credit card required. After the trial, full access is available under two plans, in euros, tax included: an annual plan at €19.99/year or a monthly plan at €2.99/month. For users who create an account before official launch, this price is locked for life for as long as the subscription stays active without interruption.

Depending on how you installed the app, payment may be processed directly by LBC or through Google Play or the Apple App Store. In the latter case, the purchase is also subject to that platform's own terms and billing policies.

6. Auto-Renewal and Cancellation

Paid subscriptions renew automatically at the end of each billing period (monthly or annual) unless cancelled before the renewal date. Cancellation takes two clicks from the app settings, or can be done directly from your Google Play / App Store account if the purchase was made through those platforms. Cancellation takes effect at the end of the period already paid for; except where required by law, no pro-rata refund is issued for the current period.

7. Right of Withdrawal

Under French consumer law (article L221-28 of the Code de la consommation), the standard 14-day right of withdrawal does not apply to digital content whose performance has started with your express agreement and waiver of that right. By subscribing to a paid plan and getting immediate access to the Service, you consent to this immediate performance and waive your right of withdrawal for that period. During the free trial month, you may cancel at any time at no cost and with no obligation.

8. Acceptable Use

When using the Service, you agree not to:

• Use the Service for any unlawful or fraudulent purpose.
• Attempt to decompile, disassemble or reverse-engineer the application.
• Scrape, extract or resell the Service's data or content.
• Disrupt the Service or attempt to access data that does not belong to you.
• Impersonate another person or provide inaccurate account information.

Any breach of these commitments may lead to the suspension or termination of your account, as described in section 12.

9. Intellectual Property

The Service, its brand, source code, content and design are the exclusive property of LBC and are protected by French and international intellectual property law. These Terms grant you only a personal, non-exclusive, non-transferable right to use the Service, to the exclusion of any other right.

How we process your personal data is detailed in our Privacy Policy, which forms an integral part of these Terms.

11. Liability and Warranties

The Service is provided "as is", without any guarantee of continuous availability or error-free operation. Balm is an organizational aid: LBC cannot be held liable for the consequences of a missed appointment, an undelivered notification, or any loss resulting from use of, or inability to use, the Service. To the extent permitted by law, LBC's liability is limited to the amount you have actually paid over the previous twelve months.

12. Termination by the Publisher

LBC reserves the right to suspend or terminate access to an account in the event of a breach of these Terms, with reasonable notice except in cases of serious misconduct requiring immediate action (fraud, a security breach affecting the Service, or unlawful use).

13. Changes to These Terms

LBC may amend these Terms at any time, in particular to reflect changes to the Service or to applicable law. In the event of a material change, users will be notified by email or in-app notification before it takes effect. Continued use of the Service after such notice constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the French courts shall have exclusive jurisdiction, subject to any mandatory consumer-protection provisions of your country of residence if you are located outside France.
